COMMON QUESTIONS ABOUT STEP PARENT ADOPTION:

If the biological parent does not consent to adoption, can my child still be adopted by stepparent?

If the biological parent has not provided emotional or financial support when able to do so for a specific time period, then their consent to the adoption may not be necessary.

Is my ex-spouse still responsible for support?

The biological parent is no longer responsible for child support after their parental rights are terminated.  However, the biological parent is still responsible for previously owed support.

Is there an age limit for a stepparent adoption?

No. Children of all ages can be adopted.

In New York State, a child 14 years or older must consent to the adoption.
